Although the session is only a week old, the leadership wasted no time in introducing a construction defects bill sponsored by the Democratic Speaker of the House and the GOP Senate President (SB-45) “Construction Defect Claim Allocation of Defense Costs.” Observers suggest it is an attempt to set a nonpartisan tone for this year’s legislature. While the bill does tackle a key issue, it doesn’t get to the heart of the problem and thus it is more symbolic than substantial. CAR’s Legislative Policy Committee (LPC) will begin its deliberations on real estate related bills such as SB-45 later this week. Its positions on key bills will be outlined here in the weeks ahead.
